Welcome to Webwave AI Chatbot. These Terms of Service ("Terms") govern your access to and use of the Webwave AI Chatbot platform, website, and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Webwave AI Chatbot", "we", "us", or "our" refers to the company operating the Webwave AI Chatbot platform.
  • "User", "you", or "your" refers to the individual or entity using the Service.
  • "Bot" refers to an AI-powered chatbot created through the Service.
  • "End User" refers to visitors who interact with your Bot on your website.

2. Account & Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration.

3. Service Description

Webwave AI Chatbot provides a platform that allows you to create AI-powered chatbots, train them on your content (URLs, PDFs, Q&A pairs, and text), embed them on your website, capture leads, view conversation analytics, and route conversations to human agents via Telegram or WhatsApp.

4. Free Trial & Subscriptions

New accounts receive a free 3-day trial with limited usage (5 messages, 1 bot). After the trial, you must subscribe to a paid plan to continue using the Service. Subscription fees are billed monthly via Razorpay. All prices are in Indian Rupees (INR) and inclusive of 18% GST.

You may upgrade, downgrade, or cancel your subscription at any time from the billing dashboard. Cancellations take effect at the end of the current billing cycle. No refunds are provided for partial billing periods.

5. Usage Limits

Each plan includes a monthly message limit, bot limit, and knowledge source limit. When your message limit is reached, your Bot will stop responding until the next billing cycle or until you upgrade. One "message" is defined as one question sent by an End User; bot responses do not count toward the limit.

6. Your Content & Data

You retain ownership of all content you upload or provide to the Service ("Your Content"), including training data, bot configurations, and branding. You grant us a limited, non-exclusive license to process, store, and use Your Content solely for the purpose of providing the Service to you.

You represent and warrant that you have the right to use and share any content you upload, including website content, PDFs, and other materials. You are responsible for ensuring Your Content does not infringe on any third-party rights.

7. End User Data

Conversations between End Users and your Bot, as well as any lead information collected, are stored on our servers and accessible through your dashboard. You are responsible for informing End Users about data collection and complying with applicable privacy laws (including but not limited to India's Digital Personal Data Protection Act, GDPR, and CCPA where applicable).

8. Acceptable Use

You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purpose.
  • Upload content that is defamatory, obscene, or infringes intellectual property.
  • Attempt to reverse-engineer, decompile, or access the Service's source code.
  • Use the Service to send spam, phishing messages, or misleading information.
  • Circumvent usage limits, rate limits, or security measures.
  • Resell access to the Service without prior written consent.
  • Use the Service in a way that could harm other users or the platform.

9. AI-Generated Responses

The Service uses third-party AI models (Anthropic Claude) to generate chatbot responses. While we strive for accuracy, AI responses may occasionally be incorrect, incomplete, or inappropriate. You acknowledge that:

  • AI responses are generated based on your training data and may not always be accurate.
  • You are responsible for reviewing and ensuring the quality of your Bot's responses.
  • We are not liable for any decisions made based on AI-generated content.
  • You should not rely on the Service for medical, legal, or financial advice.

10. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Webwave AI Chatbot and protected by intellectual property laws. Nothing in these Terms grants you any right to our trademarks, logos, or brand assets beyond what is necessary to use the Service.

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees. Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after account termination.

You may delete your account at any time by contacting support. Active subscriptions must be cancelled before account deletion.

12. Limitation of Liability

To the maximum extent permitted by law, Webwave AI Chatbot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
